What Are My Options If My Car Accident Was Partly My Fault?

In Florida, personal injury laws are not just black or white. There isn't always a clear winner or loser in each car accident lawsuit. When two people are involved in an accident, their versions of what happened are often a little different. Additionally, it is rare when only one person is completely at fault for the accident.

Sorting out who is responsible for your injuries can get very complicated. Our experienced personal injury attorneys at the Coral Springs and Boca Raton offices of Heller & Heller, P.A., understand how overwhelming your recovery can be. Throughout the entire claims process, we will explain the issues in terms you can understand. This will help you make the best decisions for yourself and your family.

When Multiple People Are at Fault for an Accident

You do not need to know all the fancy terms lawyers use in order to understand how the legal system works. Florida applies a "comparative negligence" rule to motor vehicle accident claims. This rule may allow you to recover at least some of your losses even if you were partially at fault. Here is an example of how it works:

  • Adam and Betty were in a car crash that caused serious injuries to both of them. Through the investigation process (or according to what was proved in court), it was determined that Adam was 75 percent at fault for causing the accident while Betty was 25 percent at fault.
  • Betty had medical expenses, lost earnings due to time missed from work and endured pain and suffering for a total of $100,000. Because she was 25 percent at fault for the accident, what she wins will be reduced by that percentage. She will be awarded $75,000.
  • Adam also suffered $100,000 in losses from the accident. However, since he was 75 percent at fault, he will be awarded only $25,000.

Of course, many accidents are much more complicated than this example. If you are in an accident that is caused — at least partially — by another's negligence, seek the advice of an experienced car accident lawyer at Heller & Heller, P.A. We will help you prove the facts of your claim, obtain the best possible outcome and get you back on your feet.
