As attorneys who have helped many families through relocation issues, we know that there are reasons for moving. It could be a job transfer or a new job with excellent opportunities for the parent. The custodial parent might be remarrying someone in another city or state. There may be extended family issues that make a relocation necessary.

Whatever the reason for the relocation, the court needs to know.

Even if both parents agree to the move, the relocating parent needs to file a notice of intent to relocate with the court. Why? The court's orders need to be changed to make the move legal. Also the non-custodial parent may decide later that the move was not a good idea — and there would be no legal documentation of the court's approval. Talk to a lawyer who can explain your rights.

As the non-custodial parent, can you object to your child's relocation?

If you are the non-custodial parent and the custodial parent wants to move your child a long distance, you have the right to object. You need to file your objection quickly. Talk to an attorney about your rights and your reasons for objecting to the move.

Mediation is required if the parents cannot agree.

Before the judge hears the case, the parents must go to mediation to try to work out an agreement. Is this move in the best interests of your child? Will the non-custodial parent be able to maintain a close relationship with the child? What will travel and other expenses be? Your attorney can help you find the answers and work toward a solution.
